Who can file a construction lien in Ontario?+
Any person or company that supplied labour, materials, or services to improve a property in Ontario and has not received payment. This includes general contractors, subcontractors, material suppliers, equipment providers, and labourers.
What is the deadline to file a construction lien?+
60 days from the date you last supplied work or materials to the project. This deadline cannot be extended. Once it passes, the right to file a construction lien is permanently lost and the amount owed to you has no legal claim against the property.
What does a construction lien do?+
It places a legal claim on the property title. The owner cannot sell or refinance until the lien is resolved. It is the strongest payment protection available under the Ontario Construction Act.
How much does it cost to file a construction lien?+
LienFile’s standard filing is $650 plus HST for deadlines six or more days away. Rush filing is $850 plus HST. Urgent filing for one day or less is $1,150 plus HST. Hiring a lawyer directly typically costs $1,500 to $3,000 or more.
Can I file a construction lien on my own?+
You have the legal right to do so. However, since 2016, all construction liens in Ontario must be filed electronically through the province’s authorized land registry system. Access to this system requires authorization that most individuals and businesses do not have, which is why the vast majority of filings are handled by a lawyer or a professional filing service.

What happens after a construction lien is filed?+
The lien remains on the property title for 90 days. During that time, you can negotiate a settlement. If payment is not received, you must commence a court action to enforce the lien or it will expire. LienFile sends you a reminder before this deadline and can connect you with a lawyer if enforcement is required.
What if I have already missed the 60 day deadline?+
A construction lien is no longer available once the 60 day window has closed. Depending on the amount and circumstances, you may still be able to recover through Ontario Small Claims Court for claims up to $50,000. Contact our office and we will help determine your next step.
